1. Introduction and Scope

This Privacy Policy explains how R3 Stem Cell and its affiliated Centers of Excellence (“R3 Stem Cell,” “we,” “us,” or “our”) collect, use, disclose, and protect information when you visit r3stemcell.com (the “Site”), submit a form, request a consultation, or otherwise interact with us online. It also describes the privacy rights available to you and how to exercise them.

This Policy covers website and online data practices. If you become a patient at an R3 Stem Cell-affiliated clinic, the protected health information (“PHI”) we create or receive in the course of providing treatment is governed separately by the clinic’s HIPAA Notice of Privacy Practices (“NPP”), not by this Policy. See Section 8 (“HIPAA and Protected Health Information”) below. Information you submit through this Site before a treatment relationship begins — for example, through a contact, consultation-request, or newsletter sign-up form — is governed by this Policy and by applicable state law until that relationship begins.

By using the Site, you acknowledge the practices described in this Policy. If you do not agree, please do not use the Site or submit information to us.

2. Information We Collect

2.1 Information You Provide Directly

When you use a form on the Site, request a consultation, subscribe to communications, or contact us, you may provide:

Identifiers and contact information: name, mailing address, email address, phone number, and similar identifiers.
Health and consultation information: symptoms, conditions, medical or treatment history, and other health-related information you choose to describe when requesting information about a procedure or scheduling a consultation.
Demographic information: such as date of birth or age range, where relevant to eligibility for a procedure.
Payment information: processed by our payment processor(s) for deposits or purchases made through the Site; we do not store full payment card numbers on our own servers.
Communications: records of your correspondence with us, including messages sent via web forms, chat, email, or phone.

2.2 Information Collected Automatically

When you visit the Site, we and our service providers automatically collect:

Device and technical data: IP address, approximate location derived from IP address, browser type, operating system, device identifiers, and referring/exit pages.
Usage data: pages viewed, links clicked, time spent on pages, and similar interaction data, typically collected through cookies, pixels, and similar technologies (see Section 3).

2.3 Information From Other Sources

Marketing and advertising platforms (for example, aggregate campaign performance data from Meta, Google, or TikTok advertising tools).
Referral sources, such as a physician, ambassador, or existing patient who refers you to us.
Publicly available sources.

2.4 Sensitive and Health-Related Information

Some of the information described above — particularly health, medical, or treatment-related information you volunteer in a consultation or intake form — is “sensitive personal information” under state comprehensive privacy laws and/or “consumer health data” under laws such as Washington’s My Health My Data Act and Nevada’s consumer health data law. We describe the additional protections that apply to this information in Section 6.

3. Cookies and Online Tracking Technologies

We and our service providers use cookies, web beacons/pixels, software development kits, and similar technologies (collectively, “Cookies”) on the Site, including:

Essential Cookies: necessary for the Site to function (e.g., form submission, security).
Analytics Cookies: help us understand how visitors use the Site (e.g., Google Analytics or similar tools).
Advertising/Retargeting Cookies and Pixels: used on marketing pages of the Site, including pages that contain consultation and intake forms, to measure advertising performance and to show you relevant ads on other sites (for example, Meta/Facebook Pixel, Google Ads tags, and comparable tools). 3.1 Your Cookie Choices

Browser controls: Most browsers let you block or delete cookies through their settings; doing so may limit some Site functionality.
Ad industry opt-outs: You can opt out of interest-based advertising from participating companies through the Digital Advertising Alliance (optout.aboutads.info) and Network Advertising Initiative (optout.networkadvertising.org).
Global Privacy Control (“GPC”): We honor GPC and comparable opt-out preference signals as a valid request to opt out of the “sale” or “sharing” of personal information for California and other applicable state-law visitors.
Do Not Track: The Site does not currently respond to browser “Do Not Track” signals other than GPC as described above.

4. How We Use Your Information

We use the information we collect to:

Respond to your inquiries and requests for information about our services;
Schedule and manage consultations and appointments;
Communicate with you, including sending requested information, appointment reminders, and, where you have consented, marketing communications;
Operate, maintain, secure, and improve the Site;
Understand aggregate usage trends and measure the effectiveness of our content and advertising;
Detect, investigate, and prevent fraud, abuse, and security incidents;
Comply with applicable law, regulatory requirements, and legal process; and
With your consent, for any other purpose disclosed to you at the time of collection.

We do not use health information you submit through the Site to make decisions that produce legal or similarly significant effects about you through solely automated means.

5. How We Share Your Information

We disclose personal information to the following categories of recipients:

SMS opt-in and phone numbers collected for SMS communication purposes will not be shared with any third party or affiliates for marketing purposes.
Service providers: vendors that process information on our behalf under contract, such as website hosting, scheduling/CRM platforms, email/SMS communication tools, and payment processors.
R3 Stem Cell affiliated entities: our affiliated companies and Centers of Excellence, which may include [R3 STEM CELL TO CONFIRM CURRENT LIST OF LEGAL ENTITY NAMES, e.g., Greene Technologies, LLC; R3 Stem Cell Research; R3 Medical Training; Dux Bio; and affiliated Centers of Excellence], for purposes consistent with this Policy.
Advertising and analytics partners: as described in Section 3, certain automatically-collected and form-submitted information may be shared with advertising and analytics platforms. Where this constitutes a “sale” or “sharing” under applicable state law, you have the rights described in Section 8.
Professional advisors and regulators: attorneys, accountants, auditors, and regulatory or law enforcement authorities where required by law, to protect our rights, or to protect the safety of any person.
Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to appropriate confidentiality protections.
With your consent: for any other purpose you direct or approve.

We do not sell or share consumer health data for money or other valuable consideration except as permitted under Section 6, and we do not sell or share personal information belonging to individuals we know to be under 16 years of age.

6. Consumer Health Data Notice

This section is provided under state consumer health data laws, including Washington’s My Health My Data Act and Nevada’s consumer health data law, which apply in addition to — and impose stricter rules than — general state privacy laws for certain health-related information, regardless of whether HIPAA applies to that information.

6.1 Consumer Health Data We Collect

Information you provide describing symptoms, conditions, diagnoses, treatment interests, or similar health information in a consultation-request or intake form; and information related to attempts to obtain health care services, such as the specific procedure pages you inquire about.

6.2 Consent and Authorization

We collect consumer health data only as reasonably necessary to provide the services you request, or with your affirmative, opt-in consent for other disclosed purposes.
We obtain separate consent before sharing consumer health data with a third party for a purpose beyond providing the services you requested.
We will not sell consumer health data, or exchange it for anything of value, without your valid, signed authorization meeting the requirements of applicable law.

6.3 No Geofencing Around Health Care Facilities

We do not implement geofencing technology to establish a virtual boundary around a healthcare facility for the purpose of identifying, tracking, collecting data from, or sending notifications or advertisements to consumers regarding their consumer health data or health care services.

6.4 Your Consumer Health Data Rights

You may:

Confirm whether we are collecting, sharing, or selling consumer health data about you, and access that data;
Withdraw your consent to our collection or sharing of your consumer health data;
Request deletion of your consumer health data, including data we have shared with service providers or affiliates; and
Appeal a decision we make regarding your request, as described in Section 8.3.

7. HIPAA and Protected Health Information

Certain R3 Stem Cell-affiliated clinics are HIPAA covered entities. Once you become a patient, the protected health information we create or receive in connection with your treatment (for example, your medical record, treatment notes, and billing records) is governed by the Health Insurance Portability and Accountability Act (“HIPAA”) and by the clinic’s Notice of Privacy Practices, not by this website Privacy Policy. Information you submit through this Site before you become a patient — such as through a general contact or consultation-request form — is handled under this Privacy Policy and applicable state law, as described in Section 6, until a treatment relationship is established.

8. Your Privacy Rights (U.S. State Law)

Depending on where you live, you may have rights under a state comprehensive privacy law, including the California Consumer Privacy Act (as amended by the CPRA), and comparable laws in Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, and other states, including Indiana, Kentucky, and Rhode Island, which took effect in 2026. Subject to certain exceptions, these rights may include the right to:

Know / access the specific pieces and categories of personal information we have collected about you, and the categories of sources, purposes, and third parties involved;
Correct inaccurate personal information;
Delete personal information we have collected from or about you;
Obtain a portable copy of your personal information;
Opt out of the “sale” or “sharing” of your personal information, and of targeted/cross-context behavioral advertising;

8.2 How to Exercise Your Rights

Submit a request using the contact information in Section 12. We will need to verify your identity before responding, which may require confirming information you have already provided to us. You may also designate an authorized agent to submit a request on your behalf, subject to verification. We will respond to verifiable requests within the time required by applicable law (generally 45 days, extendable once by an additional 45 days with notice to you).

8.3 Appeals

If we decline to act on your request, you may appeal by replying to our response or contacting us using the information in Section 12. We will respond to your appeal within the time required by applicable law. If your appeal is denied, some states allow you to submit a complaint to that state’s Attorney General.

9. International Visitors (EU/UK GDPR)

If you are located in the European Economic Area or United Kingdom, the EU General Data Protection Regulation (“GDPR”) or UK GDPR may apply to our processing of your personal data through the Site.

9.1 Legal Bases for Processing

Consent — for example, for marketing communications or non-essential cookies;
Performance of a contract — to respond to your consultation request or provide requested services;
Legitimate interests — to operate, secure, and improve the Site, balanced against your rights; and
Legal obligation — to comply with applicable law.

Where we process health information (a “special category” of data under Article 9 GDPR), we rely on your explicit consent, or another applicable legal basis such as the provision of health care.

9.2 Your GDPR Rights

You may request access, rectification, erasure, or restriction of your personal data; object to processing based on legitimate interests or for direct marketing; request portability of data you provided to us; and withdraw consent at any time without affecting the lawfulness of processing before withdrawal. You may also lodge a complaint with your local supervisory authority.

9.3 International Data Transfers

Where we transfer personal data from the EEA or UK to the United States, we rely on appropriate safeguards such as the EU Standard Contractual Clauses and the UK International Data Transfer Addendum. We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Policy, including to provide requested services, comply with legal, tax, and recordkeeping obligations (which for certain medical and billing records may require multi-year retention under state law), resolve disputes, and enforce our agreements. Retention periods vary by data category; consumer health data is retained only as long as necessary to fulfill the purpose for which it was collected, unless a longer period is required by law or authorized by you.

12. Data Security

We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, or disclosure. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we become aware of a breach affecting your personal information, we will notify you and applicable regulators as required by law.

13. Third-Party Links

The Site may link to third-party websites we do not control. This Policy does not apply to those sites, and we encourage you to review their privacy policies.

14. Changes to This Policy

We may update this Policy from time to time to reflect changes in our practices or applicable law. We will post the revised Policy on this page with an updated “Effective Date,” and, for material changes, provide additional notice as required by applicable law (for example, before collecting additional categories of consumer health data or expanding sharing with new categories of third parties). We encourage you to review this Policy periodically.
